Driver Agreement
Effective Date: May 2026
This Driver Agreement governs participation on the Loadster platform as an independent driver, hauler, transporter, carrier, owner-operator, fleet operator, or service provider. By using Loadster as a Driver, you agree to this Agreement, the Terms of Service, Privacy Policy, Payment Policy, Claims Policy, and Prohibited Items & Illegal Activity Policy.
1. Platform Status
Loadster is a technology platform that connects Customers with independent Drivers. Loadster is not a motor carrier, freight carrier, moving company, trucking company, transportation provider, logistics provider, freight forwarder, warehouse provider, or employer.
Loadster does not transport cargo, does not take possession of cargo, and does not control the manner in which Drivers perform transportation services.
2. Independent Contractor Status
Drivers are independent contractors and are not employees, agents, partners, joint venturers, franchisees, or representatives of Loadster. Drivers retain sole discretion over whether to use the platform, which jobs to bid on, what prices to charge, what equipment to use, and how services are performed.
3. Driver Responsibilities
- Maintain valid licenses, registrations, permits, and insurance.
- Operate vehicles, trailers, and equipment legally and safely.
- Provide truthful account, insurance, business, and vehicle information.
- Comply with all applicable local, state, and federal laws.
- Safely load, secure, transport, and deliver cargo when applicable.
- Comply with pickup, delivery, and customer communication requirements.
- Do not transport prohibited items or participate in unlawful activity.
4. Insurance
Drivers are solely responsible for maintaining all insurance required by law, including automobile liability, commercial auto, cargo, general liability, workers' compensation, or other coverage where applicable. Loadster does not provide insurance unless expressly stated in writing.
5. Vehicle and Equipment Responsibility
Drivers are solely responsible for vehicle condition, equipment condition, maintenance, inspections, repairs, load securement, and safe operation. Loadster is not responsible for vehicle breakdowns, equipment failures, cargo securement failures, or transportation interruptions.
6. No Guarantee of Work or Earnings
Loadster does not guarantee job availability, bid acceptance, customer demand, earnings, revenue, profits, business opportunities, or continued access to the platform.
7. Payments and Payouts
Driver payouts are processed through third-party payment providers. Loadster may delay, hold, adjust, reverse, offset, or withhold payouts where reasonably necessary for fraud review, chargebacks, claims, safety concerns, legal requests, policy violations, or risk-management purposes.
8. Safety and Legal Compliance
Drivers shall not operate while impaired, fatigued in violation of law, reckless, unsafe, threatening, abusive, discriminatory, or unlawful. Loadster may immediately restrict or terminate Driver access for safety concerns.
9. Prohibited Activity
Drivers may not use Loadster for human trafficking, child trafficking, child exploitation, forced labor, drug trafficking, stolen property, fraud, theft, money laundering, smuggling, terrorism-related activity, or any unlawful purpose.
Loadster maintains a zero-tolerance policy for human trafficking, child exploitation, sexual exploitation of minors, forced labor, and any activity involving the abuse or exploitation of persons.
10. Investigations and Records
Loadster may review, preserve, and disclose records including messages, job records, bid records, payment records, photographs, pickup confirmations, delivery confirmations, identity records, device information, and location information where available for fraud prevention, safety, disputes, litigation defense, insurance, compliance, and law-enforcement cooperation.
11. Account Suspension and Termination
Loadster may suspend, restrict, investigate, terminate, or permanently ban Driver accounts at any time, with or without notice, for safety, fraud-prevention, legal, operational, reputational, compliance, or business reasons. Drivers may not create new accounts to evade enforcement actions.
12. Assumption of Risk
Drivers acknowledge that transportation, hauling, moving, loading, unloading, and delivery involve inherent risks, including accidents, cargo damage, theft, personal injury, death, equipment failure, road hazards, weather, criminal conduct, and property damage. Drivers voluntarily assume those risks.
13. Limitation of Liability
To the maximum extent permitted by law, Loadster shall not be liable for cargo loss, cargo damage, cargo theft, vehicle damage, property damage, personal injury, lost profits, lost opportunities, or consequential, incidental, special, exemplary, or punitive damages.
14. Indemnification
Driver agrees to defend, indemnify, and hold harmless Loadster LLC and its owners, officers, employees, contractors, affiliates, agents, successors, and assigns from claims, losses, damages, liabilities, penalties, costs, and attorneys' fees arising from Driver conduct, transportation services, cargo claims, accidents, violations of law, or violations of platform policies.
15. Arbitration and Class Action Waiver
Disputes shall be resolved through binding individual arbitration to the fullest extent permitted by law. Drivers waive participation in class actions, collective actions, representative actions, and class arbitrations.
