Customer Agreement

Effective Date: May 2026

This Customer Agreement governs use of Loadster by any person or business posting, requesting, arranging, purchasing, or receiving transportation, hauling, delivery, moving, or related services.

1. Platform Status

Loadster is a technology marketplace connecting Customers with independent Drivers. Loadster is not a motor carrier, freight carrier, moving company, trucking company, freight broker, logistics provider, warehouse operator, or employer of Drivers.

2. Customer Responsibility

Customers are solely responsible for accurate job postings, pickup information, delivery information, cargo descriptions, dimensions, weights, special handling requirements, contact information, and compliance with applicable laws.

3. Cargo Disclosure

Customers must accurately disclose the type, quantity, weight, size, condition, value, fragility, hazards, loading needs, unloading needs, access limitations, and special requirements of all cargo. Failure to disclose accurate information may result in cancellation, additional charges, claim denial, or account enforcement.

4. High-Value Cargo

Customers are solely responsible for identifying high-value cargo, including antiques, artwork, collectibles, machinery, commercial equipment, vehicles, luxury goods, electronics, memorabilia, or other valuable property. Loadster does not provide valuation, appraisal, insurance, or reimbursement unless expressly stated in writing.

5. Packaging and Preparation

Customers are responsible for ensuring cargo is properly packaged, prepared, accessible, lawful, and safe for pickup and delivery unless otherwise agreed with the Driver. Drivers may refuse unsafe, inaccessible, improperly prepared, or inaccurately disclosed cargo.

6. Prohibited Items and Illegal Activity

Customers may not use Loadster for illegal drugs, stolen property, counterfeit goods, unlawful weapons, unlawful hazardous materials, human trafficking, child trafficking, child exploitation, forced labor, fraud, theft, money laundering, smuggling, or any unlawful purpose.

7. Payments

Customers authorize Loadster and its payment processors to collect payments, verify payment methods, process refunds where authorized, assess fees, reverse transactions where permitted, and take actions necessary to enforce platform policies.

8. Chargebacks

Customers agree not to initiate false, improper, or fraudulent chargebacks. Loadster may contest chargebacks and submit evidence including job records, messages, photos, delivery confirmations, payment records, device information, and location information where available.

9. Claims

Cargo damage, loss, shortage, theft, and property damage claims must be submitted according to the Loadster Claims & Cargo Damage Policy. Submitting a claim does not guarantee reimbursement, compensation, insurance coverage, or recovery.

10. Assumption of Risk

Customers acknowledge transportation involves risks including delays, accidents, cargo damage, cargo loss, theft, weather, equipment failures, third-party conduct, and property damage. Customers voluntarily assume risks associated with arranging transportation through the platform.

11. Fraud Prevention and Investigations

Loadster may investigate false claims, false damage reports, payment fraud, identity fraud, cargo misrepresentation, chargeback abuse, or other suspicious activity. Customers must cooperate with reasonable investigations.

12. Limitation of Liability

To the maximum extent permitted by law, Loadster shall not be liable for cargo loss, cargo damage, cargo theft, delays, missed deadlines, property damage, personal injury, lost profits, or consequential damages. Loadster's total liability shall not exceed the greater of platform fees received by Loadster for the transaction or $100.

13. Indemnification

Customer agrees to defend, indemnify, and hold harmless Loadster from claims, losses, damages, liabilities, costs, penalties, and attorneys' fees arising from Customer conduct, cargo, inaccurate information, violations of law, or violations of platform policies.
