This Claims, Insurance & Incident Reporting Policy governs cargo damage, cargo loss, cargo theft, property damage, personal injury, vehicle damage, insurance disputes, delivery disputes, and other incidents arising from use of the Loadster platform.
1. Loadster Is Not Responsible For Claims
Loadster is a technology platform that connects Customers with independent Drivers.
Loadster is not a motor carrier, freight carrier, transportation provider, moving company, logistics company, warehouse operator, insurer, insurance broker, insurance carrier, claims administrator, claims adjuster, or guarantor of transportation services.
Loadster does not transport cargo, take possession of cargo, direct transportation operations, supervise Drivers, control delivery activities, or guarantee transportation outcomes.
Loadster does not accept responsibility for cargo damage, cargo loss, cargo theft, property damage, personal injury, vehicle damage, delays, missed deliveries, insurance disputes, or transportation-related losses.
2. Claims Must Be Directed To The Responsible Party
Any claim involving cargo damage, cargo loss, cargo theft, property damage, personal injury, vehicle damage, loading damage, unloading damage, delivery disputes, or transportation-related incidents must be pursued directly against the responsible Driver, applicable insurance provider, or other responsible party.
Drivers remain solely responsible for their transportation activities, vehicles, equipment, insurance coverage, and legal obligations.
Customers are responsible for pursuing available remedies against the responsible party and any applicable insurance carrier.
3. Incident Reporting Through Loadster
Loadster may allow Users to submit incident reports through the Platform.
Incident reporting is provided solely for documentation, recordkeeping, safety review, fraud prevention, account review, and platform administration purposes.
Submission of an incident report does not create any obligation for Loadster to investigate, mediate, settle, resolve, reimburse, compensate, insure, defend, adjust, administer, or pay any claim.
Loadster may review submitted information but is under no obligation to make findings regarding fault, liability, damages, insurance coverage, compensation, or legal responsibility.
4. Insurance Responsibility
Drivers are solely responsible for maintaining any insurance coverage required by law and any insurance coverage necessary to protect their business operations.
Loadster does not provide cargo insurance, liability insurance, commercial auto insurance, property insurance, workers' compensation insurance, medical coverage, or any other insurance coverage unless expressly stated in writing.
Insurance disputes remain solely between the applicable parties and their insurance providers.
5. Documentation & Evidence
Customers and Drivers are strongly encouraged to photograph and document cargo, equipment, vehicles, property, and delivery conditions before, during, and after transportation activities.
Users may be asked to provide photographs, videos, receipts, invoices, repair estimates, police reports, witness statements, insurance information, communications, and other supporting evidence.
Loadster may preserve records for safety reviews, fraud prevention, platform enforcement, litigation defense, regulatory compliance, and cooperation with insurance carriers or governmental authorities.
6. Fraudulent Claims & Misrepresentation
Users may not submit false, misleading, fabricated, exaggerated, fraudulent, deceptive, or unsupported incident reports.
Loadster may suspend, restrict, or permanently terminate accounts that engage in fraudulent claim activity and may refer suspected criminal conduct to law enforcement authorities.
7. Criminal Activity
Incidents involving theft, fraud, human trafficking, child trafficking, child exploitation, forced labor, stolen property, illegal goods, violence, threats, assault, or other criminal conduct may be reported to law enforcement authorities.
Loadster reserves the right to preserve evidence and cooperate fully with governmental authorities.
8. Limitation Of Liability
To the maximum extent permitted by law, Loadster shall not be liable for cargo loss, cargo damage, cargo theft, property damage, personal injury, vehicle damage, delays, business interruption, lost profits, consequential damages, incidental damages, special damages, punitive damages, or other losses arising from transportation services arranged through the Platform.
Nothing in this Policy shall be interpreted as creating insurance coverage, claim reimbursement rights, claim payment obligations, or any assumption of liability by Loadster.
